Unreal. We've never seen a Special Counsel report completely withheld from the public like this. Part of the reason they're always released is because taxpayers fund these investigations, and they cost millions.
Watergate. Iran-Contra. The Clinton investigation. Mueller. Durham. Every one of those produced public findings in some form — not because the law strictly required it, but because transparency & accountability demanded it.
The Mueller report was released under Donald Trump, even though parts were politically embarrassing. Bill Clinton allowed the Starr report to be released during his own presidency, despite how humiliating it was. The Durham report was released under Joe Biden, even though it was politically inconvenient.
Across parties and administrations, the norm has been the same: release the findings and let the public judge. But Trump has filed several court motions to try and bury this report, and under Judge Cannon, Jack Smith's report on the classified documents case is being kept secret.
Judge Cannon says releasing it would be unfair and cause "manifest injustice" to Trump and the other defendants. But there's no ongoing trial. No jury to prejudice. No sentencing at stake. "Manifest injustice" traditionally protects defendants from wrongful punishment, NOT from public scrutiny after a case is over.
In a constitutional system built on the rule of law, government power is legitimate only when it's transparent and accountable. Secret investigations and buried findings are what we criticize in authoritarian systems — not what America stands for.
Hopefully the 11th Circuit Court of Appeals will overturn this decision. Wouldn't be the first time they've reversed Aileen Cannon for overstepping in this case.
If no laws were broken, release the report and prove it. If laws were broken, the American people have a right to know.
