🚨NEW: On a press call before the House breaks for August recess, I asked @GOPMajorityWhip how he plans to win over enough Senate Democrats to support his Blockchain Regulatory Certainty Act, especially given that Senator @MarkWarner, a key moderate on @BankingGOP, has been laser-focused on illicit finance. The bill, included in Banking’s market structure discussion draft and in the House’s CLARITY Act, aims to clarify that blockchain developers and infrastructure providers (like miners, validators, and node operators) aren’t money transmitters as long as they don’t custody funds. Emmer says Warner “should love the BRCA” — calling it a non-partisan issue: “This isn’t about Republicans or Democrats…it’s about protecting Americans and making sure innovators have clear rules.” Emmer also said he trusts the Senate to take up the CLARITY Act and pass it — and if they make adjustments or improvements to it along the way, “that’s great.”

I’m surprised @UpholdInc hasn’t been acquired. Uphold’s valued at about $1.5-$2B. I’m surprised @coinbase ($100B) @RobinhoodApp ($90B) @Ripple ($30B) or @krakenfx ($10B) haven’t yet made a play. I think a TradFi Company like @CharlesSchwab ($173B) would be smart to pull the trigger.

Out of over 2K Exhibits submitted by the parties, Judge Torres only cited a few dozen in her Summary Judgment Decision - XRP Holder Affidavits was one of them. When ruling secondary market sales of XRP NOT securities, she ALSO cited my efforts as amicus counsel for @naomibrockwell in the @LBRYcom case (see FN 16 of the Decision). One hour after the Torres Decision, @coinbase @krakenfx and others relisted XRP for trading and we made HISTORY defeating the @SECGov. NEVER let someone tell you that you can’t make a difference and that it’s useless fighting the Government. The XRP Holders who joined the cause deserve much credit. @naomibrockwell deserves credit for taking the risk of highlighting herself by allowing me to represent her as amicus counsel.
