In per curiam ruling today (with no recorded dissent), Supreme Court rules that 50-page opinion by Fourth Circuit judge Roger Gregory (in Clark v. Sweeney) "departed dramatically from the principle of party presentation." Complete vindication of Judge Marvin Quattlebaum in dissent. Given that Gregory's opinion was unpublished, this is a hopeful sign that Supreme Court is paying more attention to Fourth Circuit mischief.
